Welcome to Goshen ("Goshen," "we," "us," or "our"). By accessing or using our services, including our website (goshenites.com), membership offers, digital products, coaching programs, community platforms, events, and any related services, you agree to be bound by the following terms and conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
2. ACCEPTANCE OF TERMS
By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and Goshen. If you are entering into these Terms on behalf of an entity, you represent that you have authority to bind that entity.
3. CHANGES TO TERMS
Goshen reserves the right to modify or revise these Terms at any time, at our sole discretion. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms periodically. Continued use of our services after any modifications indicates acceptance of the revised Terms. We may, but are not obligated to, notify you of material changes via email or through our platforms.
4. USE OF SERVICES
Goshen grants you a limited, non-exclusive, non-transferable, and revocable license to use our services for personal, non-commercial purposes. You agree not to use our services for any unlawful or prohibited activity. You may not resell, sublicense, or redistribute access to any of our services, products, or platforms without our express written consent.
5. PRODUCTS AND SERVICES
Goshen offers digital education products, coaching programs, community memberships, live and virtual events, challenges, and related services. Our product offerings, pricing, features, availability, and delivery methods may change at any time without prior notice. By purchasing or enrolling in any Goshen product or service, you agree to these Terms and any additional terms presented at the time of purchase.
Goshen makes no guarantees regarding the specific features, duration, or availability of any product or service beyond what is explicitly stated on the applicable sales or enrollment page at the time of your purchase. We reserve the right to modify, discontinue, replace, or update any product or service at our sole discretion.
6. REFUND POLICY
All sales are final. We do not offer refunds for any membership fees, digital products, coaching programs, event tickets, or other services, except as may be explicitly stated on the sales page or enrollment agreement for a specific offer at the time of purchase.
If a specific product or offer includes a refund policy or guarantee, the terms of that specific policy will be stated at the time of purchase and will govern that transaction. Any such guarantee requires full compliance with the stated conditions, and the decision to issue any refund remains at the sole discretion of Goshen.
To request a refund where applicable, contact us at support@goshenites.com. Refund requests must be submitted in writing and will be reviewed on a case-by-case basis.
7. RIGHT TO DECLINE SERVICE
Goshen reserves the right to refuse service to anyone at our sole discretion, without providing a reason.
8. THIRD-PARTY TOOLS AND SERVICES
Certain Goshen products or programs may include access to third-party tools, software, platforms, or services as part of the offering. These third-party tools are not owned, developed, operated, or controlled by Goshen. Access to third-party tools is provided as a benefit of your enrollment and is subject to the terms, conditions, and privacy policies of the respective third-party provider.
Goshen does not guarantee the availability, accuracy, reliability, or performance of any third-party tool or service. Third-party providers may modify, limit, or discontinue their tools or services at any time without notice from Goshen. Goshen is not responsible for any loss, damage, or liability arising from your use of any third-party tool or service.
Your use of any third-party tool is at your own risk. You agree to comply with all applicable terms and conditions of the third-party provider. Goshen makes no warranties, express or implied, regarding any third-party tool or service, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of outputs, or non-infringement.
If access to a third-party tool is discontinued or modified by the third-party provider, Goshen is not obligated to provide a replacement, refund, or credit related to that tool.
9. PAYMENT AND BILLING
All payments for Goshen products and services are processed through third-party payment processors, including but not limited to Stripe, Kajabi, Whop, and Fanbasis. Goshen does not directly store or process your credit card or payment information. Your use of these payment processors is subject to their respective terms of service and privacy policies.
Buy Now, Pay Later (BNPL) or installment payment options, where available, are provided exclusively through third-party financing services. Goshen does not offer, administer, or manage any in-house payment plans, financing arrangements, or installment agreements. If you use a third-party BNPL service, your agreement is with that third-party provider, and you are responsible for all payments, fees, and obligations under their terms. Goshen is not responsible for any disputes, fees, interest, or penalties arising from your use of third-party payment or financing services.
You agree to pay all applicable fees for the products and services you purchase. All prices are listed in U.S. dollars unless otherwise stated. Pricing is subject to change without notice.
10. CHARGEBACKS AND DISPUTES
You agree to contact Goshen directly at support@goshenites.com before initiating any chargeback, dispute, or payment reversal with your bank, credit card company, or payment processor. Filing a chargeback without first attempting to resolve the issue with Goshen may result in immediate termination of your access to all Goshen products, services, and platforms, and may be considered a breach of these Terms.
If a chargeback is filed and subsequently reversed in Goshen's favor, you may be responsible for any fees or costs incurred by Goshen as a result of the dispute.
11. EARNINGS DISCLAIMER
Goshen provides digital education, coaching, and business training content. Our programs are designed to provide knowledge, strategies, and frameworks that may assist you in building or growing a business. However, individual results vary and depend on many factors, including but not limited to your individual effort, experience, business acumen, market conditions, personal circumstances, and factors beyond anyone's control.
GOSHEN MAKES NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES OF ANY KIND REGARDING YOUR POTENTIAL EARNINGS, INCOME, REVENUE, PROFITS, OR RESULTS FROM USING OUR PRODUCTS OR SERVICES. Any income examples, revenue figures, or financial results referenced in our marketing materials, testimonials, case studies, or content are not guarantees and should not be relied upon as a promise of what you will achieve. They are shared for illustrative and educational purposes only.
Any testimonials or success stories shared by Goshen or its students represent the individual experiences of those particular individuals. Their results are not typical, and your results may differ materially. Testimonials are not intended to represent or guarantee that current or future students will achieve the same or similar results.
You acknowledge that the success of any business venture involves risk and that there is no guarantee that you will earn any money using the techniques, strategies, or ideas presented in our products and services.
12. NOT FINANCIAL, LEGAL, OR PROFESSIONAL ADVICE
Goshen is a digital education and coaching company. We are not a registered investment advisor, broker-dealer, financial planner, licensed attorney, certified public accountant, or any other type of licensed professional. Nothing in our products, services, content, or communications should be construed as financial advice, investment advice, tax advice, legal advice, or any other form of professional advice.
Any information provided by Goshen is for general educational and informational purposes only. You should consult with a qualified professional regarding your specific financial, legal, tax, or business situation before making any decisions based on information from our products or services.
Goshen, its owners, employees, coaches, contractors, and affiliates disclaim any liability for actions you take or do not take based on information provided through our services.
13. ASSUMPTION OF RISK
By purchasing or enrolling in any Goshen product, service, program, or event, you acknowledge and agree that:
(a) Building a business involves inherent risks, including the risk of financial loss.
(b) Results from educational and coaching programs are not guaranteed.
(c) You are solely responsible for your own business decisions and their outcomes.
(d) You are participating voluntarily and at your own risk.
(e) Goshen is not responsible for any business losses, financial losses, or other damages resulting from your use of our products or services.
14. CONTENT OWNERSHIP AND INTELLECTUAL PROPERTY
All content, materials, curricula, course materials, workbooks, templates, frameworks, branding, trademarks, service marks, graphics, logos, and other intellectual property related to our services are the exclusive property of Goshen, unless otherwise noted. You agree not to reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, or otherwise exploit our content without express written permission.
Your purchase of a product or enrollment in a program grants you a limited, personal, non-transferable license to access and use the content for your own personal and business purposes. This license does not transfer ownership of any intellectual property to you.
Unauthorized reproduction, distribution, or sharing of Goshen content may result in termination of your access and may subject you to legal action.
15. TERMINATION
We may terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of our services, us, or third parties, or for any other reason. Upon termination, your right to use our services will immediately cease, and you will not be entitled to any refund.
16. PARTICIPATION AND CONDUCT POLICY
Goshen reserves the unconditional right to remove or deny access to any individual, at any time and at its sole discretion, from any program, membership, online or in-person event, or offering. This may occur with or without prior warning and without refund.
Grounds for removal include, but are not limited to:
- Disruptive behavior of any kind
- Use of offensive, inappropriate, or abusive language
- Violation of community guidelines or event rules
- Behavior deemed unsafe, disrespectful, or misaligned with Goshen's values
- Any action that interferes with the learning environment or the experience of others
- Harassment of Goshen staff, coaches, or other participants
By participating in any Goshen event or program, you acknowledge and accept this policy as binding and non-negotiable.
17. LAND 6-WEEK COACHING PROGRAM
The Land 6-Week Coaching Program comes with a money-back guarantee under the following conditions:
18. Active Participation: You must join the live Zoom sessions with our experts or watch the recorded sessions. Active participation is required in the Follow-up Boss software to track your progress throughout the 6 weeks.
19. Effort and Commitment: You are expected to put in genuine effort to implement the strategies and advice provided during the coaching program. This includes completing assignments, participating in discussions, and making a sincere attempt to follow the program guidelines.
20. Refund Request: If, after meeting the above conditions, you are not satisfied with the program, you may request a refund. The refund request must be submitted within 30 days of completing the 6-week program. Your request will be reviewed, and if it is determined that you have fulfilled the participation and effort requirements, a full refund will be issued.
Disclaimer: The decision to issue a refund is at the sole discretion of the program administrators. Failure to meet the participation and effort requirements will result in the forfeiture of the money-back guarantee.
By enrolling in the Land 6-Week Coaching Program, you agree to adhere to these Terms and Conditions.
Once a student completes the graduation form, they acknowledge and agree that they have fully participated in and benefited from the program. Completion of the graduation form signifies the following: The student confirms they have completed the 6-Week Land Coaching Program. The student has fully learned all the material and found it beneficial. The student agrees not to repurpose, share, or distribute any program materials, acknowledging their protection under intellectual property laws. The student surrenders their right to claim the money-back guarantee.
By submitting the graduation form, the student agrees to these terms, thereby forfeiting any eligibility for a refund under the money-back guarantee policy. For any questions or further clarification, please contact our support team.
18. GOSHEN DIGITAL LAUNCH -- "LEARN UNTIL YOU EARN" GUARANTEE
The Goshen Digital Launch program includes a "Learn Until You Earn" guarantee under the following terms. This guarantee is a limited offer and is subject to all conditions stated below.
Guarantee Terms: Students enrolled in the Goshen Digital Launch program receive live support and mentorship for three (3) months, or until they achieve their first $5,000 in digital product revenue, whichever comes first. This forms the basis of the "Learn Until You Earn" guarantee.
THIS GUARANTEE IS ONLY AVAILABLE WHILE THE GOSHEN DIGITAL LAUNCH PROGRAM IS ACTIVELY BEING SOLD AND OFFERED TO NEW STUDENTS. Goshen reserves the absolute and unconditional right to end, cancel, modify, or discontinue the Goshen Digital Launch program, or any component of it, at any time and for any reason at its sole discretion. If and when Goshen decides to discontinue the program, the "Learn Until You Earn" guarantee immediately terminates along with it. Upon program discontinuation, Goshen shall have no further obligation to provide coaching, mentorship, support, or any services under this guarantee, regardless of whether a student has reached the $5,000 revenue threshold.
Extended support beyond three (3) months may be provided at Goshen's sole discretion, but is not guaranteed and is subject to reasonable usage guidelines.
Refund Policy for Goshen Digital Launch: All sales of the Goshen Digital Launch program are final. Due to the digital nature of the program and immediate access to proprietary materials, no refunds, returns, or exchanges will be issued once purchase is completed. By purchasing, you acknowledge and agree that you are waiving any right to a refund, regardless of usage, results, or participation. Please ensure this program is the right fit for you before purchasing. If you have questions, contact us at support@goshenites.com prior to checkout.
Program Access: Upon enrollment, you will receive access to the Goshen Digital Launch community (available as long as the community remains active on the platform), the core recorded training program (lifetime access to the recorded content), and access to any included third-party tools for the duration specified at the time of purchase. Goshen reserves the right to change the method of access (for example, moving to a new platform, private group, or cloud-based system). Lifetime access strictly applies to the core recorded program content only and does not guarantee perpetual access to live support, community features, coaching, or third-party software.
Usage Guidelines: All purchases are for individual use only. Sharing login details, content, or resources is strictly prohibited and may result in termination of access without refund. Access to any included third-party tools is subject to fair and reasonable use. Abuse of any system (including but not limited to spamming, excessive automated usage, or activity deemed unreasonable) may result in suspension or termination of access without refund.
Disclaimer: The Goshen Digital Launch program exists for educational purposes only. No guarantees of income are made. The "Learn Until You Earn" guarantee ensures continued coaching support as described above -- it does not guarantee that you will earn $5,000 or any specific amount. Actual results depend entirely on individual effort, market conditions, and factors beyond Goshen's control.
19. USER CONDUCT
You agree not to:
- Use our services in any manner that could disable, overburden, damage, or impair our services or interfere with any other party's use of our services.
- Attempt to gain unauthorized access to any portion of our services or any other systems or networks connected to our services.
- Use any robot, spider, or other automatic device, process, or means to access our services for any purpose, including monitoring or copying any of the material on our services.
- Share, resell, or distribute your login credentials or access to any Goshen platform, product, or service.
- Use content from our programs to create competing products or services.
- Misrepresent your affiliation with Goshen or any Goshen product or service.
20. MARKETING, SMS, AND EMAIL
Consent to Receive SMS: By providing your phone number, you agree to receive SMS notifications and promotional messages from Goshen. Consent is not a condition of any purchase. Message and data rates may apply. You may opt-out at any time by replying STOP to any SMS message you receive.
Frequency of Messages: You may receive up to 4 messages per month.
Opt-out Instructions: To stop receiving SMS messages from us, reply STOP at any time, or contact us at support@goshenites.com.
Email Communications: By providing your email address and/or purchasing any product or service, you consent to receive email communications from Goshen, including but not limited to transactional emails, marketing emails, newsletters, and promotional offers. You may unsubscribe from marketing emails at any time using the unsubscribe link in any email.
Disclaimer of Liability: We are not liable for any delays or failures in receiving SMS or email messages due to issues beyond our control, such as mobile carrier service failures, spam filters, or internet service disruptions.
21. ELECTRONIC COMMUNICATIONS CONSENT
By using our services, you consent to receive communications from Goshen electronically, including via email, SMS, push notifications, and through our platforms. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
22. AFFILIATE AND REFERRAL PROGRAM
Goshen may offer affiliate or referral programs from time to time. Participation in any affiliate or referral program is subject to the specific terms and conditions of that program as communicated at the time of enrollment.
Affiliates and referral partners agree to promote Goshen products and services in a truthful, non-misleading manner that complies with all applicable laws, including but not limited to the Federal Trade Commission (FTC) guidelines regarding endorsements, testimonials, and advertising disclosures.
Affiliates must clearly disclose their relationship with Goshen in any promotion, review, or endorsement. Affiliates may not make income claims, earnings guarantees, or results promises on behalf of Goshen. Violation of these requirements may result in immediate termination from the affiliate program and forfeiture of any unpaid commissions.
23. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Goshen and its respective officers, directors, employees, agents, contractors, coaches, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; (d) any claim that your actions caused damage to a third party; or (e) any business decisions you make based on information from our services.
24. DISCLAIMER OF WARRANTIES
Our services are provided on an "as is" and "as available" basis. Goshen disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure. We do not warrant that any results or outcomes will be achieved through the use of our services.
25. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Goshen shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our services; (vi) the defamatory, offensive, or illegal conduct of any third party; or (vii) any business losses, lost revenue, lost profits, or financial damages arising from your use of or reliance on our services. In no event shall Goshen's aggregate liability exceed the amounts paid by you to Goshen in the past twelve (12) months.
26. BINDING ARBITRATION AND CLASS ACTION WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of our services (collectively, "Disputes"), shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and not by a court or jury.
CLASS ACTION WAIVER: YOU AND GOSHEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, the entire arbitration provision shall be void.
Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.
Opt-Out: You have the right to opt out of this arbitration provision by sending written notice of your decision to opt out to support@goshenites.com within 30 days of first accepting these Terms. If you opt out, the remaining provisions of these Terms will continue to apply.
The arbitrator may award any relief that a court could award, including injunctive or declaratory relief. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction.
27. STATUTE OF LIMITATIONS
You agree that any claim or cause of action arising out of or related to your use of our services or these Terms must be filed within one (1) year after such claim or cause of action arose. Failure to file within this period shall result in the permanent barring of such claim.
28. FORCE MAJEURE
Goshen shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond Goshen's reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions or orders, war, terrorism, riots, embargoes, internet or technology failures, platform outages, power failures, payment processor disruptions, third-party service disruptions, or any other force majeure event.
29. GOVERNING LAW AND JURISDICTION
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Subject to the arbitration provision above, you agree that the state and federal courts located in Harris County, Texas shall have exclusive jurisdiction to settle any dispute or claim that is not subject to arbitration.
30. INTELLECTUAL PROPERTY RIGHTS
All intellectual property rights in our services, including but not limited to trademarks, service marks, graphics, logos, and content, are owned by Goshen or our licensors. You are granted no right or license with respect to any of these intellectual property rights except as expressly stated in these Terms.
31. THIRD-PARTY LINKS
Our services may contain links to third-party websites or services that are not owned or controlled by Goshen. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Goshen shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
32. USER-GENERATED CONTENT
If you submit, post, or otherwise make available any content on our services, you grant Goshen a perpetual, non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media. You represent and warrant that you own or have the necessary rights and permissions to use and license the content as provided herein. Goshen reserves the right to remove any user-generated content at its sole discretion.
33. FEEDBACK
Any feedback, comments, or suggestions you may provide regarding Goshen or our services are entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.
34. PRIVACY AND DATA
Goshen collects and uses personal information as described in our Privacy Policy, which is available at goshenites.com. By using our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
We collect phone numbers solely for the purpose of sending SMS notifications and promotional messages. Your phone number will not be shared or sold to any third parties for their independent marketing purposes, and it will be stored securely in compliance with applicable data protection laws.
You may opt-out of SMS messages at any time by replying STOP. If you wish to delete your phone number from our records, please contact us at support@goshenites.com.
We will retain your phone number for as long as you are subscribed to our SMS list or until you request deletion.
We use third-party services to manage and send SMS and email messages. Your information may be shared with these services for the sole purpose of delivering messages. These services are required to comply with applicable data privacy laws.
We process personal data in accordance with applicable laws. If you are located in a jurisdiction with specific data protection regulations (such as GDPR or CCPA), additional rights and protections may apply as described in our Privacy Policy.
35. DATA SECURITY
We implement appropriate technical and organizational measures to protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
36. SEVERABILITY
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be struck. The remaining provisions shall be enforced to the fullest extent under law.
37. WAIVER
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Goshen's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
38. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any product-specific terms presented at the time of purchase, constitute the entire agreement between you and Goshen with respect to our services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Goshen.
